As a British Columbia Roster Parenting Coordinator, this work is carried out using the most current standard participation agreement, and only within the authority expressly or implicitly conferred.This article explains how extracurricular activities are addressed where parenting coordination jurisdiction includes assisting with communication and the implementation of shared parental responsibilities, and how section 40(2) of British Columbia’s Family Law Act (FLA) informs best practice in that context.<h3>Section 40(2) and Shared Decision‑Making</h3>Section 40(2) of the FLA provides that, unless an agreement or order says otherwise, parents who share parental responsibilities are expected to consult with each other about decisions affecting their child.The section states, in part, that parents are to exercise their responsibilities “in consultation with each other.”Section 40(2) does not resolve every disagreement, nor does it eliminate conflict. It does, however, establish a legislative expectation of consultation, communication, and information‑sharing where responsibilities are shared.Where a Parenting Coordinator has jurisdiction to assist with implementation, section 40(2) is applied as an implementation standard, particularly in high‑conflict cases where unilateral decision‑making or information control has undermined shared parental responsibilities.<h3>Parenting Coordination and Disclosure Obligations</h3>Where parenting coordination jurisdiction includes implementing shared parental responsibilities, meaningful disclosure is required so that consultation can occur as contemplated by the order or agreement.This includes disclosure about:• Proposed extracurricular activities• Waiting lists• Schedules, locations, and time commitments• Costs• How the activity would affect parenting timeNon‑disclosure cannot be used as a form of gatekeeping or indirect decision‑making.Within the scope of delegated authority, parenting coordination does not permit one parent to:• Act first and disclose later• Preserve an advantage by withholding information• Control access to activities by managing information flowWithout disclosure, consultation cannot occur. Without consultation, shared parental responsibilities cannot be implemented as ordered.<h3>Waiting Lists Do Not Decide the Issue</h3>Placing a child on a waiting list does not determine whether the child will participate in an activity.A waiting list simply preserves availability. As a matter of implementation‑focused coaching, proposals should be limited to information necessary to allow consultation to occur, including the nature of the activity, schedule, time commitment, costs, and impact on parenting time. The purpose of the proposal is to support consultation and implementation, not persuasion, argument, or outcome control.The proposal should contain:• The name and nature of the activity• Schedule and location• Time commitment• Costs and proposed payment arrangement• Why the activity may be appropriate given the child’s age, needs, and existing schedule<h3>What to Avoid</h3>(General parenting coordination coaching only, not the exercise of binding authority)• Avoid framing the proposal as “the child wants this”• Avoid presenting the child as having already committed• Avoid repeatedly discussing the proposal with the childChildren are usually open to many activities. For that work to be effective, the process depends on openness, candour, and a shared understanding of how information is handled.One issue that occasionally causes difficulty is the recording of conversations without notice or consent. Because this can undermine the process itself, it is important to understand how recording is addressed in Parenting Coordination.<h2>Recording and the Parenting Coordination Process</h2>Participation in Parenting Coordination is governed by the appointing order and the applicable participation agreement. These documents set out clear expectations about confidentiality and privacy, including limits on recording meetings or communications without the express, written consent of all participants.These provisions are not about secrecy or control. They exist to ensure that Parenting Coordination functions as intended: a problem‑solving process focused on implementation rather than evidence‑gathering.<h3>Why Undisclosed Recording Creates Problems</h3>Parenting Coordination is not a court process. It is not adversarial, and it does not operate on the assumption that conversations are being preserved for later use. The work often involves plain language, clarification of misunderstandings, and frank discussion of options and consequences within the scope of existing orders.When a conversation is secretly recorded, several difficulties arise.First, it changes how people communicate. Participants may become guarded, less willing to speak openly, or reluctant to explore solutions if they believe their words may later be extracted from context and repurposed.Second, recordings almost never capture full context. The person controlling the recording decides when it starts and stops. Tone, lead‑up, clarification, and resolution are often missing. When energy is spent preserving material “just in case,” the process can quietly move from problem‑solving to self‑protection. That shift tends to prolong conflict rather than reduce it.<h3>Criminal Law Versus Process Expectations</h3>Some parents are told that recording a conversation is lawful if they are a participant. Whether or not recording meets the threshold of a criminal offence is a separate question from whether it is appropriate within a voluntary, contract‑based dispute resolution process.Parenting Coordination is governed by the terms of participation and by professional standards, not solely by criminal law. Conduct that is technically lawful can still be inconsistent with the expectations of the process the parents have agreed to use.<h3>Raising Concerns Without Recording</h3>Recording is not necessary to raise concerns, seek clarification, or set boundaries.If a parent is troubled by something said during a meeting or conversation, a constructive approach is to document their recollection and raise the issue directly. For example:• noting the comment and the context in which it was made• asking for clarification about what was intended• explaining how the comment was received• identifying what would be helpful going forwardStating one’s perception and requesting clarity or adjustment does not require proof or recordings. Parenting Coordination is not about proving misconduct; it is about addressing issues so implementation can continue.<h3>Transparency Outside the PC Process</h3>Parents sometimes ask about recording interactions outside of Parenting Coordination sessions. As with many aspects of post‑separation parenting, transparency is key.Where communication is intended to be business‑like and predictable, undisclosed recording can erode what limited trust exists. One term that often causes misunderstanding is the description of a Parenting Coordinator (PC) as a “neutral third party.”While well‑intentioned, that phrase can be misleading unless it is carefully explained. Parenting coordination involves different functions at different stages, and clarity about those functions helps parents understand both what to expect—and what not to expect—from the process.<h3>Neutrality in Facilitation</h3>When a Parenting Coordinator is assisting parents to reach agreement within the scope of an existing order or agreement, the PC functions in a neutral, facilitative role. In this phase, the PC helps parents communicate, identify workable options, and resolve implementation issues by consensus where possible.This facilitation is intentionally structured and contained. Unlike family law mediation, it is not designed to explore past grievances, renegotiate settled arrangements, or broadly examine parental interests. The focus remains on resolving the immediate parenting issue in a way that is consistent with the governing order and the child’s needs.<h3>Why Neutrality Changes at Determination</h3>If parents are unable to reach agreement, the Parenting Coordinator may be required to make a Determination, but only within the limited authority granted by statute and the appointing order or agreement.At that point, neutrality in outcome is no longer possible or appropriate.A Determination is not about preferring one parent over the other. It is about applying the existing parenting framework to the facts at hand so that the parenting arrangement continues to function and the child is not left in uncertainty.<h3>The Governing Standard: Impartiality</h3>The correct standard for Parenting Coordinators when making Determinations is impartiality.Impartiality means fairness in process, consistency in application, and fidelity to the governing legal framework—not indifference to outcome.In practice, this means the Parenting Coordinator is committed to:• No bias toward either parent• Equal process, including a fair opportunity for both parents to provide relevant information• Strict adherence to the existing order or agreement• A singular focus on the child’s best interests as reflected in, and constrained by, the existing order or agreement when a decision must be made.<h3>The Child’s Best Interests Are Not Neutral</h3>A Parenting Coordinator is impartial between parents, but not neutral with respect to the child.When a Determination is required, the PC is legally obligated to choose the course of action that most faithfully implements the governing order and, in doing so, supports the child’s stability, development, and well‑being.If one parent’s proposal aligns more closely with those requirements, the PC must adopt it—even if the other parent experiences that outcome as unfair or disappointing.A Determination that does not adopt a parent’s position is not evidence that the PC failed to listen, explore interests, or remain fair. It reflects the limited and child‑focused nature of the PC’s mandate.<h3>Why This Structure Builds Fairness</h3>Parenting coordination is designed for families where open‑ended negotiation has not produced stability. The structure, limits, and decisional authority of the PC are intentional safeguards—not signs of rigidity or bias.By clearly distinguishing facilitation from determination, and neutrality from impartiality, the parenting coordination process aims to be predictable, transparent, and fair—while keeping the child out of ongoing parental conflict.It is also important to understand that a Parenting Coordinator’s best‑interests analysis is intentionally contained. The PC does not conduct a broad or open‑ended reassessment of parenting arrangements, revisit past findings, or re‑weigh historical factors already addressed by agreement or court order. While the legal duty is straightforward, the practical reality can be much more challenging. Many parents find themselves struggling not because they lack good intentions, but because they lack a shared framework for navigating conflict, communication, and decision-making.Over the years, I have developed a growing library of articles, handouts, and educational resources to support parents in that process. The Legal Starting Point: Agreement or Order</h3>The first and most crucial step is to determine if a formal agreement or court order is already in place regarding the child's schooling. If so, you must follow it. If not, parents should strive to reach a mutual decision. In British Columbia, the Family Law Act provides a framework for making decisions in a child's best interests. Section 37 outlines factors a court considers when making parenting orders. These factors can also be helpful for parents when thinking through schooling decisions together.&nbsp; 2. Location and Community: Splitting the Difference or Staying Put?A key question is whether the child should attend school in the catchment of one parent or somewhere in the middle. There are pros and cons to each approach:<ul><li>Attending school in a parent's catchment area: This provides a sense of community, stability, and belonging as the child can build friendships and participate in local activities with friends. They'll have a consistent peer group and access to local amenities. The child may feel like a visitor rather than a resident in both places. Are there any special attributes that resonate with the child's needs? Consider schools with strong athletic programs, French immersion, or trades-focused education if those align with your child's interests and aptitudes. Financial and Practical Considerations</h3>Can you afford private school? Private school may offer a unique educational experience but often comes with a significant cost. Both parents must be in agreement and able to contribute financially. If the child attends school in one parent's area, can they still participate in extracurriculars in the other parent's area? This requires a great deal of coordination and may not always be practical. However, if the parents are willing to cooperate, it can be a great way to ensure the child maintains a connection to both communities.<h3>5. The Power of Compromise</h3>When parents are at odds, seeking a compromise is often the best path forward, as it helps avoid a costly and stressful determination.Here are some ways to find a middle ground:<ul><li>Divide extracurriculars: Maybe the child attends school in one location and participates in a main sport or club in the other.</li><li>Focus on the big picture: Remember that a child's sense of stability, security, and love is more important than where they attend school.</li><li>Reducing the Commute Together: It's important to remember that a long daily commute is a burden on the child, not just the parent doing the driving. One parent's decision to move shouldn't automatically mean the child has to spend an extra hour in a car or in childcare. An excellent compromise is to share the driving. This could mean that the parent who lives farther away meets the other parent halfway, or that you work together to manage drop-offs and pickups. Two parents, Jane and Mark, lived in the same city and agreed that their children would attend daycare close to their respective workplaces. Later, Jane decided to move an hour away to another suburb. As a parent, it’s natural to want your children to feel safe, happy, and secure, especially after separation or divorce. Co‑parenting brings its own challenges, and one issue that often creates tension is sharing basic information about where the children will be during parenting time, such as the city or province you’re travelling to when an order or agreement already contemplates that information being shared.For some parents, this can feel intrusive or unnecessary.
